General Conditions of Contract for the Sale of Tourist Packages

SEL - Sport & Event Logistics srl has stipulated, pursuant to Article 47, paragraph 2, of Legislative Decree 62/2018  Professional Civil Liability policy with YOUR INSURANCE n. 4032451000286.

THE  tourist packages sold with the contract governed by these general conditions, are assisted by a guarantee for the reimbursement of the price paid for the purchase of the tourist package and the immediate return of the tourist, in cases of insolvency or bankruptcy pursuant to the provisions from the 2nd paragraph of art. 47 of the Tourism Code. For this purpose SEL - Sport & Event Logistics srl1 declares to adhere to having signed a Professional Civil Liability policy with TUA INSURANCE n. 4032451000286. Travelers can contact this entity or, if necessary, the authority such as the Antitrust Authority, based in Rome P.zza Verdi 6 ° - tel. 06 858211 - if the services are denied due to the insolvency of the organizer or the seller.


Currencies and exchanges
The quotas in the catalog, when presenting the individual products and confirming the services, unless otherwise stated, are to be considered expressed in euros

Individual file management fee €  for each adult and €  for each child between 2 and 12 years of age enrolled in the travel package at the time of booking and / or confirming the services.

Any variation requested by the traveler after the confirmation of the services included in the package will result in the tourist being charged of € 50.00 per file; in the event that the airline tickets have already been issued at the time of the change by the tourist, the penalties and expenses provided for by IATA or the carrier will be charged in addition to the modification costs indicated above, in addition to the payment to the organizer of all the additional expenses incurred to proceed with the change. In the event of substantial changes to the practice, such as change of destination or change of departure date, the cancellation penalties set out in this technical sheet may be applied. The change of the name of the renouncing customer with that of the substitute may not be accepted by a third service provider, in relation to some types of services, even if carried out within the deadline.

The organizer will therefore not be responsible for any non-acceptance of the modification by third party service providers. This non-acceptance will be promptly communicated by the organizer to the interested parties before departure.

At the time of booking a deposit equal to 30% of the price of the tourist package must be paid as reported by the
  General Conditions of Participation, while the balance must be paid at least thirty days before the departure date, unless otherwise specifically agreed in writing. For bookings made from the thirtieth day prior to departure, the full amount of the tourist package must be paid at the time of booking. Failure to make the above payments on the established dates constitutes an express termination clause of the contract, without prejudice to compensation for further damages suffered by the organization.

Cancellation penalties

To the traveler  who withdraws from the contract before departure outside of the hypotheses listed in the  General Conditions of Contract for the Sale of Tourist Packages, will be charged - regardless of the payment of the deposit and unless otherwise specified below and / or when confirming the services - the individual management fee, the cost of insurance coverage and, except unless otherwise specified on the presentation pages of the individual products of this brochure and / or during the confirmation of the services, the penalties calculated as a percentage of the gross participation fee as indicated below:

No cancellation fees up to 30 days before the scheduled date.

30% cancellation fees up to 20 days before the date

50% cancellation fee up to 10 days before the date

75% cancellation fees up to 4 days before the date

90% up to 24 hours before the date.

No refunds will be given for cancellations made less than 24 hours before the start of the tour. If the customer does not show up on the agreed date, there will be no refund


The reference is always to "calendar" days. In the event that the airline tickets have already been issued at the time of cancellation by the tourist, in addition to the penalties indicated above, the penalties and expenses envisaged by IATA or by the carrier will be charged. In any case, no refund is due to the traveler  who decides to interrupt the trip or stay or not to use the services regularly booked and accepted in the contract for the sale of tourist packages. In the case of pre-established closed groups, these sums will be agreed from time to time at the signing of the contract. Important: some periods of the year or some particular destinations or tourist services (e.g. New Year's Eve, Caribbean or theatrical performances, etc.) may provide for booking, payment and cancellation rules imposed by the suppliers of the services themselves, which are completely particular and may not coincide with the above rules. The related booking, payment and cancellation penalties will be specified to the traveler by the organizer and / or the seller at the time of booking.

The non-attribution to the traveler of the impossibility of taking advantage of the holiday does not legitimize the withdrawal without penalties, provided by law only for the objective circumstances that can be found at the destination of the holiday referred to in paragraph 2 or for the hypotheses referred to in paragraph 1, being provided the possibility of guaranteeing oneself from the economic risk connected to the cancellation of the contract, with the stipulation of a specific insurance policy, where not provided in the form inclusive of the organizer.


Pursuant to art ex art. 47 1st paragraph lett. g. Consumer Code, we inform you that the right of withdrawal is excluded in contracts concluded at a distance. Pursuant to art. 41 paragraph 7 of the tourist code, we inform you that the right of withdrawal is excluded in contracts negotiated away from business premises in the case of offers with significantly lower rates compared to competing offers. The cancellation penalties provided for in the technical sheet are therefore applicable to the traveler / consumer who withdraws from the contract signed at a distance or away from business premises with significantly reduced rates compared to competing offers. Pursuant to Article 59 of the Consumer Code, Legislative Decree 6 September 2005, n. 206 amended following Legislative Decree 21 February 2014 n.21, the right of withdrawal is excluded in relation to contracts for the supply of accommodation, transport, car rental services, catering or services relating to free time activities, if the contract provides for a specific date or period for performance. Therefore, the cancellation penalties provided for and indicated in each individual service are applicable to the consumer who withdraws from the contract signed remotely or negotiated away from business premises.


The rates of the tourist packages and the descriptions of the tourist services published in the catalog may be subject to variations, unless the modification is disseminated to intermediaries.


The excursions, services and services purchased by the tourist on site and not included in the price of the tourist package are unrelated to the subject of the relative contract stipulated by SEL - Sport & Events Logistics srl in the role of organizer. Therefore, no responsibility can be ascribed to SEL - Sport & Events Logistics srl neither as organizer nor as service intermediary even in the event that, as a courtesy, residents, companions or local correspondents can take care of booking such excursions.


The name of the carrier who will carry out your flight (s) is indicated on the booking confirmation sheet; any changes will be communicated to you  promptly, in compliance with Regulation 2111/2005.



Information for our travelers

For technical-organizational reasons during the booking or during the journey the itinerary may be subject to changes.

The program described below respects all the regional, national and international government measures in force at the time of its elaboration.

The structures and services proposed in our programs, following the restrictive measures put in place by the individual States to contain the infection from Covid-19, may have limitations in the use and / or performance of the program and the standard services provided. Our suppliers will follow the safety protocols adopted in compliance with the laws in force in the country of destination.

If there are changes to these measures that affect the services provided, the quotas may undergo variations, such as: difficulties in reopening some planned hotels, these will be replaced with others of the same category, if any; some visits may also be canceled or replaced with others, depending on any new access rules to places of interest; limitations on the maximum number of passengers on means of transport.

However, we will do everything possible to keep the odds and itinerary unchanged.

The traveler is invited to carefully examine the characteristics of the tourist package offered in order to have full knowledge of the type and peculiarities of the trip and to make an informed choice.

The tourist package organized with the mountain bike travel formula requires technical preparation.

In the case of unaccompanied travelers with reduced mobility, pregnant women, minors unaccompanied by parents or another authorized person and people in need of specific medical assistance, but also if you simply have doubts about your ability to tackle the itinerary described in the travel poster, the traveler is invited  to contact the organizer before booking in order to choose the most appropriate solution to allow participation in the trip in safe conditions.

The organizer reserves the right to refuse the booking or the departure of the traveler in the event that the characteristics of the booked trip are incompatible or excessively risky for the health or safety of the traveler who has omitted information relating to his technical preparation and / or health condition. . In such cases, the organizer will reimburse the amount already paid net of the non-refundable expenses already incurred up to the time of the refusal of the booking and / or departure. 

For each travel program, a scale of difficulty is indicated - the key of which is shown below - which represents the type and fundamental characteristics of the trip in order to make the traveler aware of the difficulties of the trip and allow him to acquire all the information useful for deciding whether or not the characteristics and difficulties of the trip are compatible with your psychophysical conditions.

Standard information form for package travel contracts in situations other than those referred to in part I


The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302. Therefore, you will benefit from all EU rights that apply to packages. SEL - Sport & Events Logistics srl will be fully responsible / responsible for the correct execution of the package as a whole. Furthermore, as required by law, the company SEL - Sport & Events Logistics srl has a protection to reimburse your payments and, if transport is included in the package, to guarantee your repatriation in case you become insolvent.

Fundamental rights under Directive (EU) 2015/2302

1. Travelers will receive all essential information on the package prior to the conclusion of the package travel contract.

2. There is always at least one professional responsible for the correct execution of all tourist services included in the contract.

3. Travelers are given an emergency telephone number or the details of a contact point through which they can reach the organizer or travel agent.

4. Travelers may transfer the package to another person upon reasonable notice and possibly at additional costs.

5. The price of the package can only be increased if specific costs increase (for example, fuel prices) and if expressly provided for in the contract, and in any case no later than 20 days from the start of the package. If the price increase is greater than 8% of the package price, the traveler can terminate the contract. If the organizer reserves the right to increase the price, the traveler is entitled to a price reduction if there is a decrease in the relevant costs.

6. Travelers may terminate the contract without paying termination fees and obtain full refund of payments if any of the essential elements of the package, other than the price, have changed substantially. If, before the start of the package, the professional responsible for the package cancels the package, travelers are entitled to obtain reimbursement and, if applicable, compensation.

7. Travelers may, in exceptional circumstances, terminate the contract without paying termination fees prior to the start of the package, for example if there are serious security issues at the destination that may affect the package. - Furthermore, travelers may at any time, before the start of the package, terminate the contract upon payment of adequate and justifiable termination fees.

8. If, after the start of the package, substantial elements of the package cannot be provided as agreed, suitable alternative solutions must be offered to the traveler, at no additional cost. Travelers can terminate the contract, without paying termination fees, if the services are not performed as agreed and this significantly affects the execution of the package and the organizer has not remedied the problem.

9. Travelers are also entitled to a price reduction and / or compensation for damages in the event of failure or non-compliant execution of the tourist services.

10. The organizer is required to provide assistance if the traveler is in difficulty. - If the organizer or, in some Member States, the retailer becomes insolvent, payments will be refunded. If the organizer or, where applicable, the seller becomes insolvent after the start of the package and if transport is included in the package, the repatriation of the travelers is guaranteed. SEL - Sport & Events Logistics srl has signed insolvency protection with  [insert name of entity responsible for insolvency protection, for example a guarantee fund or insurance company or, where applicable, the competent authority]. Participants in our bike tours / excursions  they must comply at all times with the highway code and the laws on the use and abuse of illegal substances such as drugs and alcohol. SEL srl is not responsible for injuries or damage caused by malicious or negligent behavior of the tour participants, by accidental falls and by accidents that occur during the tours / excursions. Participants must decide for themselves if they are able or in an appropriate state to be able to complete the tour / excursion safely. During guided and self-guided tours / excursions and bike rental, it is mandatory to wear a bike helmet when using the bike.

Rental and storage of bicycles and bicycle accessories

SEL srl is required to ensure that all rental equipment is in operational condition at the beginning of the rental period. With their signature, the renter (hereinafter referred to as "the traveler") declares that the equipment is in good working order. The traveler must show a personal identity document. The customer must consent to the compilation of the necessary personal data. And to the payment of a deposit. SEL srl reserves the right to withhold this deposit in the event that the bicycle or the accessories of the rented bicycle are not returned, or returned with significant damage. This does not release the traveler from liability for the difference up to the damage suffered.



Minimum age requirements

The minimum age for bike rental is 18 years. Young people and children under the age of 18 will only be able to use the rental bikes under the supervision of an adult. In this case, the adult concerned is liable through his signature on the rental agreement.


Use of bicycles and bicycle accessories

The customer declares with his signature that he is in a position to use the equipment and that he is aware of the highway code, as well as being responsible for compliance with these road regulations both on and off the road. Without explicit written authorization, it is not allowed: to use bicycles on downhill routes; use bicycles for fourcross, dirt jumping or trial, use bicycles for sports competitions; re-rent bicycles or bicycle equipment to third parties. The traveler is required to secure the rental equipment against theft. When the rented bicycles are not in use, the renter is obliged to secure the bicycle to an anchored object (such as a bicycle rack or lamp pole). The customer must inform your name immediately  in case of loss or theft of the rented equipment. The traveler will be responsible for paying the costs of the value of the equipment in case of loss or theft. The customer is required to register cases of theft with the police.


Customer Liability for Equipment Damage

The traveler is obliged to return the rental material in good working order and without damage. The repair costs for damage suffered by the rented material during the rental period are charged to the traveler

No information regarding the characteristics of the services provided (flights, hotel accommodation, optional excursions, etc.) differing from those contained in the contractual documents, catalogs or other written means of communication from the organizer, from anyone provided and / or directly acquired by the tourist, may in no case constitute a source of responsibility for the organizer himself.

SEL cannot be held responsible in any way for the reliance that the customer makes on information, images and any other information (eg maps or images of Google or others, opinions of third parties, etc.) derived from other sources or present in other websites, including linked ones, which may not be reliable, updated or in any case misleading or illusory.



A valid passport is required (from a minimum of 3 months to a maximum of 6 months, depending on the country, after the date of return from the trip). It is always advisable to check the validity of the personal documents necessary for expatriation by contacting the competent authorities. The burden of verifying the regulations in force and the need for any entry visas to be carried out at the Consulate of the country of origin and destination applies even more to non-Italian citizens or citizens with dual citizenship and to passengers not belonging to the European Union for which rules relating to legal systems other than the Italian one or different from each other are applied.

If your trip involves a transit or a stay in the United States, please note that from April 1, 2016, only electronic passports to travel to the United States with the Visa Waiver Program are valid. They have a 9-digit numbering, of which 2 letters and 7 numbers (the first issued are of the AA series)

Since May 25, 2010, the electronic passport also contains fingerprints in the microchip, but to travel with the Visa Waiver Program, an electronic passport without fingerprints is also fine, as long as it has not expired and is valid until return.

Minors to benefit from the Visa Waiver Program must be in possession of an individual passport.

In order to travel to the United States under the Visa Waiver Program, it is mandatory to obtain an Electronic System for Travel Authorization (ESTA). The authorization must be obtained before departure by accessing the Electronic System for Travel Authorization (ESTA) via the Internet, paying the amount requested in  USD  at the time of the request (amount subject  subject to change without notice).   For high altitude areas, a medical examination for heart sufferers or other is recommended. The initials of the carrier who will carry out your flight (s) is indicated in the booking confirmation; any changes will be promptly communicated by the Organizer. The airlines used are not all European. The scheduled tickets issued by Italy are in the form of e-tickets (there are no more paper tickets except for some carriers used for domestic domestic flights that require them).

The airlines reserve the right to substitute, as necessary, the planned aircraft with another one owned by them or by another airline. Flight operations may be subject to variations regardless of the will of SEL - Sport & Events Logistics srl.

Code Sharing: on the basis of international commercial agreements, many airlines operate some routes under a "code sharing" regime with other carriers. It may therefore happen that an airline purchased with a specific airline and named with the airline's initials is actually operated with another carrier's aircraft and crew. Even in the case of "code sharing" flights, the safety regulations issued by ENAC are respected. Air transport: all prices, taxes and supplements indicated in the estimate phase are subject to change and will be reconfirmed at the time of booking. In the estimates that provide for scheduled flights, the price already includes any ticketing costs. Some scheduled fares require immediate ticketing upon confirmation of booking. In this case, the simultaneous payment of the airline tickets will be required and any cancellation penalties may be different from those indicated in the 'General Conditions of Contract'.

Flight schedules: flight schedules are purely indicative and do not constitute a substantial element of the travel contract; the actual flight times are also reported exclusively in the travel documents delivered to the tourist. Any changes in flight schedules are not attributable to negligence of the Organizer. The airlines in fact reserve the right to modify them at any time, for technical / operational needs of service, slots, connections or force majeure, etc., even without notice.

Any changes may involve, in addition to the change of schedules, also the change of airline and the making of unscheduled stopovers.

Pregnant women need a medical certificate for boarding, certifying the progress of the pregnancy up to the twenty-eighth week. From the twenty-ninth to the thirty-fourth week, it is necessary that the certificate, issued within three days prior to departure, certifies that you are fit to fly. In any case, it will be essential to ask the Airline, through your travel agency, for all possible boarding requirements. It is necessary to verify that the return flight falls strictly within the thirty-fourth week of gestation. Beyond the thirty-fourth week they may not be accepted on board.

Infant: the confirmation of the flight for the infant (a child who has not reached the age of two does not pay for the ticket by not occupying a seat) does not imply the confirmation of the cot, which can be provided subject to availability only upon written request at the time of the request for reservation. Some airlines do not accept business class infants.

Airport taxes: in almost all countries there are airport exit taxes to be paid directly on site: the amount to be paid is shown in the “Destination information” news sheet and is subject to change without notice.

Ticket issuing taxes not included will be communicated at the time of booking.

Baggage allowance: The baggage allowance is generally 20 kg for economy class and 30 kg for business class (superior class) for all flights. For some countries, baggage is considered as packages, the weight of which varies according to the country and the carrier and will be communicated at the time of booking the flight. In the event of excess baggage, the payment of the amount referring to the excess kg may be requested upon boarding. For some domestic flights with small aircraft the allowance can be reduced to 10 kg and there are very strict weight restrictions. All US and Canadian carriers apply a surcharge (surcharge to be paid locally) for checked and checked baggage in the hold on all domestic domestic flights. Any exceptions will be communicated at the time of booking, depending on the type of fare or ticket purchased.

For the embarkation of special baggage such as bicycles, windsurfers, diving equipment, golf bags, drones and other sports and non-sports material, it is necessary to provide information at the time of booking. However, the acceptance and boarding of these special baggage is subject to the approval of the airline and is always subject to a fee. For the limitations relating to hand baggage consult the website  Please note that every single piece of baggage must be accompanied by a specific passenger identification label.

SEL - Sport & Events Logistics srl  recommends checking and complying with the regulations in force on the export or import of objects, foodstuffs, animals, flowers, plants, etc. from protected species. 

If you are interested in buying exotic souvenirs abroad, before leaving Italy, if necessary, request appropriate information from the Ministry of the Environment or the Ministry of Economic Development or the Ministry of Agricultural and Forestry Policies-Forestry Corps of the State. In any case it is good to consult the  Regulation (EU) 1320/2014  for the appropriate checks.



At the time of the booking request some ancillary services may not be available. We therefore ask during the booking phase to write us which services are considered essential to the conclusion of the contract in order to be able to certify their actual availability. The "Optional" services are extra for a fee. The importance of  inform the Organizer in advance of any  special needs or conditions  such as food intolerances and allergies in order to verify with suppliers the actual availability and feasibility of personalized services. Any requests for reports relating to hotel accommodation (for example double bed, neighboring rooms) are never guaranteed




The hotels listed in our catalogs or on the online site have been selected directly by us, or through our correspondents, or in the case of some countries, they are booked by us through "Read data banks". In some locations there are no large hotel facilities and the hotels proposed, usually small in size, even if indicated in the first / second category, have a modest standard compared to the structures of large cities, but have in any case been selected on the basis of cleanliness and of a minimum of comfort. For convenience, the hotel classification is divided into stars, except for some hotels, lodges or other types of accommodation that do not indicate this classification. A 1/2 star hotel offers practical and essential services; if it has 3 stars it is a mid-level hotel; with 4 stars it has good services; with 5 stars they consider themselves to be of excellent level. Within the categories, the quality / price ratio must always be considered. In fact, even within the same category, there may be variations in price and quality, sometimes even significant ones. The rooms are basic double (two single beds or one double bed). In Central-South America, the United States, the Caribbean and the United Arab Emirates in general there are no triple rooms, but only doubles with more spacious beds so they are also used as triple / quadruple rooms without adding additional beds. Where the room rate does not explicitly report the number of beds available and their type (size), the use of the room is always based on the bed (s) available at the time of check-in at the hotel.

For cots, in the case of reservations with infants, we do not guarantee their presence as they are not always available in hotels and in any case always to a limited extent: it is necessary to make a specific request even if it is never guaranteed.

For infants and children who have free accommodation in the hotel - including those included in the tours - it may be required to pay for meals directly on site.

It is possible that in some periods some of the services indicated in the descriptions are not available and that in periods of low occupancy some hotels carry out routine maintenance work and improvements, as well as some hotels may change the restaurant service from "buffet" to "à la carte" ".

Complementary services (equipment, entertainment, shops, pizzerias, restaurants, minimarket, sports courses, babysitting service, mini club, etc.) are sometimes subordinated to the closing shifts connected with the relative management and may not be activated if the climatic conditions or the number of presences does not justify its functioning, or causes of force majeure (for example sudden failures) do not allow it.

Some hotels have exclusively "non-smoking" rooms, therefore smoking is prohibited, even on terraces or balconies, we ask you to  wait at the disposition of the various hotels and use only the reserved areas in order not to incur penalties and to be removed from the structure.




Hotels that offer special attention to honeymooners require a copy of the wedding certificate or publications upon check-in. The "pluses" are indicated in the description of each individual hotel and a minimum of nights stay is generally required to be eligible. In some structures where they are not indicated, it may be that the hotel provides them, but for a fee. During the tours there are no special attention. The assignment of rooms with double or king size bed is not guaranteed. Some hotels require a procedure to be followed by the customers in order to be entitled to the "plus"; we ask you to check this peculiarity in the individual hotel descriptions. Other hotels, in the presence of couples with children in tow in the same room, do not offer the spouses the expected gifts. Always check that the wording "Honeymoon" is correctly indicated on the relevant hotel vouchers.



The itineraries of the tours may vary in the sequence of visits for unforeseeable reasons or for coincidences with particular events that take place only on certain days of the week, however respecting all the visits and excursions indicated. They could also undergo variations for reasons determined by force majeure, such as bad weather conditions. It is possible to leave on dates other than those indicated in the individual tours, the trip will be carried out on an individual basis and the supplement to the basic fee will be based on the number of participants. At the end of a tour, the participants will be accompanied with a collective transfer to their respective hotels for the continuation of the stay by the sea or at the airport.

If the tour involves staying several times in the same location  and in the same hotel, at the end of each stay the rooms must be vacated by checking out. If the room is not vacated, the hotel will charge the cost. For the tours there is only a minimum of passengers, a maximum number of participants is not indicated as the tours can  be shared with other groups that make part of the same itinerary.


The cost of the car rental includes only the daily rate  with unlimited mileage unless otherwise specified. The fee does not include: insurance, petrol, security deposit, (any motorway tolls, fines, car seats for children, navigator)  supplement for second person driving and anything not expressly indicated.

Conditions: the minimum age required to drive the car is generally 21 years old. In some destinations, for example in the United States, it can be lower or higher and also differ depending on the state. For this it is necessary to reconfirm this information in the estimate.

Compulsory to be paid locally: insurance, petrol, any local taxes, guarantee deposit. For some destinations, an additional fee is required to collect the car at the airport. It is excluded that any presumption of its own could result in an implicit promise by the organizer who details the characteristics of the products explicitly in writing. On the contrary, the traveler is aware that peculiar receptive structures may have different characteristics with respect to common standards; for example, it is possible that by choosing hotels deriving from renovations of historic buildings they may have rooms without windows, or structures with particular locations (e.g. in places of geological or religious / cultural interest and in ecological reserves, etc.) '' acceptance of certain situations, local laws and / or regulations for the protection of the ecosystem, compliance with social conventions or other. It is always and in every appropriate place for personal safety to use common sense and never leave personal items unattended. In addition to the following general conditions, the description of the tourist package contained in the catalog (online or paper), or in the separate travel program, as well as the booking confirmation that is sent by the organizer to the selling agency, as the traveller's agent. In signing the tourist package sale proposal, the traveler must keep in mind that it reads and accepts, for himself and for the subjects indicated in the contract, both the tourist package contract as regulated therein, and the warnings and conditions contained therein, and these general conditions.


The sale of tourist packages and related tourist services is governed by the Tourism Code (articles 32-51 - novies) as amended by Legislative Decree 62/2018 which implements the EU Directive 2015/2302 and its subsequent amendments and by the provisions of the civil code on transport and mandate, as applicable.


The organizer and the seller of the tourist package, to whom the traveler addresses, must be authorized to carry out their respective activities on the basis of current legislation, including regional or municipal legislation and operate in accordance with the provisions therein. The Organizer and the seller established on the Italian territory must be covered by an insurance contract for civil liability in favor of the traveler for compensation for damages deriving from the violation of the respective obligations assumed with the respective contracts. The tourist package organization contracts are backed by insurance policies or bank guarantees which, in the event of insolvency or bankruptcy of the organizer or the seller, guarantee, without delay at the request of the traveler, the reimbursement of the price paid for the purchase of the package and the immediate return of the traveler in the event that the package includes the transport of the traveler, as well as, if necessary, the payment of food and accommodation before the return. This obligation also applies to professionals who facilitate related tourist services, for the reimbursement of all payments they receive from travelers,


For the purposes of this contract, the following definitions apply:

  • "durable medium": any tool that allows the traveler or professional to keep the information that is personally addressed to him in order to be able to access it in the future for a period of time adequate for the purpose for which it is intended and allows the identical reproduction of the information

  • "unavoidable and extraordinary circumstances" means a situation beyond the control of the party invoking such a situation and its consequences would not have been avoided even by taking all reasonable measures;

l) "return": the return of the traveler to the place of departure or to another place agreed by the contracting parties.


  1. A "tourist package" is defined as the combination of at least two different types of tourist services (ie: 1. the transport of passengers; 2. the accommodation that is not an integral part of the transport of passengers and is not intended for residential purposes or for language courses long-term; 3. the rental of cars, other vehicles or motor vehicles and those requiring a category A driving license; 4. any other tourist service that does not constitute an integral part of one of the 1), 2) or 3) tourist services, and does not qualify as a "tourist service integrative ") for the purposes of the same trip or vacation, if at least one of the following conditions occurs:

      1. combined after the conclusion of a contract with which the professional allows the traveler to choose from a selection of different types of tourist services, or purchased from distinct professionals through connected processes of booking through the company where the name of the traveler, the ends of the payment and the address of the last contract with which the latter was used by the professional

professionals is concluded at the latest 24 hours after confirming the booking of the first tourist service;

  1. At least two types of tourist services purchased for the purpose of the same trip are meant "connected tourist service", which constitute a package, and involve the conclusion of separate contracts with individual tourist service providers, if a professional facilitates, alternatively: ; 2) the targeted purchase of at least one additional tourist service from another professional when the purchase is concluded within 24 hours from the confirmation of the booking of the first tourist service.


2) the means, the characteristics and the categories of transport, the places, the dates and times of departure and return, the duration and the place of intermediate stop and the connections; in the event that the exact time has not yet been established, the organizer and, if applicable, the seller, inform the traveler of the approximate time of departure and return; 3) the location, the main characteristics and, where applicable, the tourist category of the accommodation pursuant to

the regulations of the country of destination; 4) the meals provided; 5) visits, excursions or other services included in the agreed total price of the package; 6) the tourist services provided to the traveler as a member of a group and, in this case, the approximate size of the group; 7) the language in which the services are provided; 8) if the trip or vacation is suitable for people with reduced mobility and, at the request of the traveler, precise information on the suitability of the trip or vacation that takes into account the needs of the traveler;

  • the methods of payment, including any amount or percentage of the price to be paid as a down payment and the calendar for the payment of the balance, or the financial guarantees that the traveler is required to pay;

  • information about the optional or mandatory subscription of insurance to cover the costs of unilateral termination of the contract by the traveler or of the assistance costs, including re-entry, in the event of injury, illness or death;

l) information on the identity of the operating air carrier, if not known at the time of booking, according to art.11 Reg. Ce 2111 \ 05 (Art. 11, paragraph 2 Reg. Ce 2111/05: "If the identity of the actual air carrier (s) is not yet known at the time of booking, the air transport contractor ensures that the passenger is informed of the name of the carrier (s) that will operate as the actual air carrier for the flight (s) In this case, the air transport contractor will ensure that the passenger is informed of the identity of the actual carrier or carriers as soon as their identity has been ascertained and their possible ban on operations in the European Union "

  1. For tourist package contracts stipulated by telephone, the organizer or professional provides the traveler with the information provided by the "standard information form" in Annex A, part II, of the tourism code.



  1. In consideration of the large advance with which the catalogs are published which report the information relating to the methods of use of the services, it is specified that the times and routes of the flights indicated in the acceptance of the offer for the sale and purchase of the services could undergo variations since the subsequent validation subjects; the definitive flight times will be communicated in the days before the departure and the return. It should be noted that the volicharters are not subject, by definition, to a systematic hourly programming.

6.1. At the time of the conclusion of the tourist package contract or, in any case, as soon as possible, the organizer or the seller, provides the traveler with a copy or a confirmation of the contract on a durable medium.

6.2 The traveler has the right to a paper copy if the tourist package contract has been stipulated in the simultaneous physical presence of the parties.

6.5 The traveler must communicate to the seller, before booking, any specific requests that are considered the subject of the contract only if possible, reported in writing in the contract and accepted by the organizer.

6.6 Travel documents (e.g. vouchers) will be delivered to the traveler in good time before departure and the traveler must keep them and carry them with him during the trip, in order to use the regularly booked services, together with any other documents (e.g. airline tickets) delivered by the seller. The traveler is required to verify the correctness of the data reported on the aforementioned documents and on the travel contract and to immediately notify the seller of any errors. The traveler must communicate to the organizer the data of the participants exactly as reported on the personal identity documents.

6.7. Any excursions, services or services purchased and paid for by travelers at their destination are unrelated to this contract. Therefore, no responsibility for this can be ascribed to the organizer or the seller, not even in the event that, as a courtesy, resident staff, companions, guides or local correspondents can take care of their booking.


7.2. Failure to pay the aforementioned sums, on the established dates, as well as failure to remit the sums paid by the traveler to the seller to the organizer, will result in the automatic termination of the contract by law, to be carried out by simple written communication, by fax or by e-mail. , at the seller, or at the domicile, including electronic, where communicated, of the traveler. The balance of the price is considered to have taken place when the sums reach the organizer directly from the traveler or through the seller.


  1. The price of the tourist package is determined in the contract, with reference to what is indicated in the catalog or on the organizer's website, or out-of-catalog / tailor-made program and any updates to the same catalogs or out-of-catalog programs subsequently intervened, or on the website of the organizer. Operator. It may vary, increasing or decreasing, only as a result of changes in: - the price of passenger transport depending on the cost of fuel or other energy sources; - the level of fees and taxes on the tourist services included in the contract imposed by third parties not directly involved in the execution of the package, including the landing board, disembarkation of the embarkation at ports and airports; - exchange rates for the package in question. A price increase is possible only upon communication on durable medium by the organizer to the traveler together with the justification for this increase and the calculation methods, at least 20 days before the start of the package. of the price, the organizer has the right to deduct the administrative and management costs of the actual practices from the reimbursement due to the traveler, of which he is required to provide proof at the request of the traveler.

8.2. The price consists of: a) registration fee or file management fee; b) participation fee: expressed in the catalog or in the quotation of the package provided by the seller to the traveler; c) cost of any insurance policies against the risks of cancellation, withdrawal and / or medical expenses or other services requested; d) cost of any visas and entry and exit taxes from the holiday destination countries; e) airport and / or port charges and taxes.


a) the number of people registered in the package is less than the minimum required by the contract and the organizer communicates the withdrawal from the contract to the traveler within the deadline set in the contract and in any case no later than 20 days before the start of the package in in the case of trips lasting more than 6 days, of 7 days before the start of the package in the case of trips lasting between 2 and 6 days, of 48 hours before the start of the package in the case of trips lasting less than 2 days ; b) the organizer is unable to execute the contract due to unavoidable and extraordinary circumstances and communicates the withdrawal from the same to the traveler without undue delay before the start of the package.


  1. The traveler can withdraw from the contract at any time before the start of the package upon payment of adequate withdrawal costs, or, if foreseen, of the standard withdrawal costs (cancellation penalties) provided by the organizer, which depend on the chosen destination and from the time which the traveler withdraws from the date of departure. In the absence of specification of the standard withdrawal costs, the amount of the fees required corresponds to the price of the package reduced by the cost savings and income resulting from the reallocation of tourist services.

  2. The traveler can take out insurance policies to cover the aforementioned unilateral withdrawal costs by the traveler and assistance costs, including re-entry, in case of accident, illness or death.

  3. Withdrawal costs are not due for the hypotheses provided for in the previous article 9 point 2. In the event of unavoidable extraordinary circumstances occurring in the place of destination or in its immediate vicinity that have a substantial impact on the execution of the package or on the transport of passengers to the destination, the traveler has the right to withdraw from the contract, before the start of the contract. of the package, without paying withdrawal costs, and to the full reimbursement of payments made for the package, but not entitled to additional compensation.

  4. In the case of contracts negotiated away from business premises (as defined by art.45 c.1 lett.h) of the consumer code), the traveler has the right to withdraw from the tourist package sale contract within a period of five days from the date of conclusion. of the contract or from the date on which it receives the contractual conditions and preliminary information if later, without penalties and without giving any reason. In the case of offers that are significantly reduced compared to current offers, the right to withdraw is excluded.

If due to supervening circumstances not attributable to the organizer it is impossible to provide, during the execution of the contract, a substantial part, for value or quality, of the combination of the tourist services implemented in the tourist package contract, the organizer offers, at no extra cost to the traveler, adequate alternative solutions of quality, equivalent or higher where possible, with respect to those specified in the contract, so that the execution of the package can continue, including the eventuality that the return of the traveler to the place of departure is not provided as agreed. If the alternative solutions proposed involve a package of lower quality than that specified in the tourist package contract, the organizer grants the traveler an adequate reduction in the price.


  1. The traveler can reject the alternative solutions proposed only if they are not comparable to what was agreed in the tourist package contract or if the price reduction granted is inadequate. 11.3. If it is impossible to arrange alternative solutions or the traveler to push the proposed alternative solutions, in accordance with what is indicated in point 1, the traveler is entitled to a reduction in the price. In the event of non-fulfillment of the obligation offered, point 15.511.4 applies. Where, due to supervening circumstances not attributable to the organizer, it is impossible to ensure the return of the traveler as agreed in the tourist package contract, points 15.6 and 15.7 apply.


a) the organizer is informed no later than seven days before the start of the package; b) the person to whom he intends to transfer the contract satisfies all the conditions for the use of the service and in particular the requirements relating to passport, visas, health certificates; c) the same services or other replacement services can be provided following the replacement; d) all administrative and practical management expenses are paid to the organizer to proceed with the replacement, to the extent that will be quantified before the transfer, providing, at the request of the transferor, the deprivation relating to rights, taxes or other additional costs resulting from the transfer . The transfer costs could include, for example, the purchase of new tickets at the rate available and in effect at the time of the transfer request; it should be noted that ticketing costs are subject to continuous changes and price fluctuations and depend on the booking class, the availability of seats, the type of fare, the class of the flight, the date of issue and the date of the flight.

12.4 If the traveler requests the change of a tourist element and / or service of an already confirmed practice and provided that the request does not constitute a contractual novation and as long as it is possible to implement it, the organizer must pay the administrative and management costs and the costs resulting from the modification itself (in the event that the air ticket office has to be reissued, the transfer will result in the application of the air fare available on that date).

The traveler must carry out the related formalities also considering that the seller or the organizer are not obliged to obtain visas or documents.

    4. If, on the date of booking, the intended destination results, from the institutional information channels, a location subject to a "discouragement or" warning "for security reasons, the traveler who subsequently has to exercise the withdrawal cannot invoke, for the purposes of the exemption or reduction of the request for compensation for the withdrawal, the acceptance of the breach of the cancellation.

    5. Travelers must comply with the rules of normal prudence and diligence and those specifications in force in the travel destination countries, with all the information provided to them by the organizer, as well as with the regulations, administrative or legislative provisions relating to the tourist package. The travelers will be called and replied to all damages by the organizer and / or the seller if they are incurred due to the failure to comply with the above obligations, including the expenses necessary for their repatriation. Furthermore, the organizer may require the traveler to pay a reasonable cost for the assistance provided to him, if the problem is caused intentionally by the traveler or to blame, in the limits of expenses.

    6. The traveler is obliged to provide the organizer or the seller with all the documents, information and elements in his possession for the exercise of the right to withdraw against the subjects which they have contributed to verifying the circumstances of the event that the compensation is subject to, the reduction of assistance and other provisions in the case of which can return to the place of departure, as well as for the exercise of the right of subrogation against third parties responsible for the damage and is liable to the organizer for the damage caused to the right of subrogation.


The official classification of hotels is provided in the catalog or in other informative material only on the basis of the express and formal indications of the competent authorities of the country in which the service is provided. In the absence of official classifications recognized by the competent Public Authorities of the EU member countries to which the service refers, or in the case of structures marketed as a "Tourist Village", the organizer reserves the right to provide its own description of the accommodation facility, such as to allow an evaluation and consequent acceptance of the same by the traveler.


  1. Pursuant to art. 42 tourism code, the organizer is responsible for the execution of all the tourist services provided by the tourist package contract, regardless of whether such tourist services must be provided by the organizer himself, by his auxiliary appointed when they act in the exercise of their functions, by third parties whose work they use, or by other tourist service providers 'art. 1228 of the civil code.

  2. The traveler, pursuant to articles 1175 and 1375 of the Italian Civil Code, informs the organizer, directly or through the seller, promptly, taking into account the circumstances of the case, of any defects in conformity detected during the execution of a tourist service provided for by the tourist package contract.

  3. If a lack of conformity, pursuant to article 1455 of the Italian Civil Code, constitutes a non-fulfillment of not insignificant importance of the tourist services included in a package, and the organizer does not remedy it within a reasonable period established by the traveler in relation to the duration and characteristics of the package, with the complaint made pursuant to point 15.2, the traveler can, without charge, resolve with immediate effect the tourist package contract or, if applicable, request, pursuant to point 16 below for a reduction in the price, without prejudice to any compensation for damages.

16.3 The traveler is not awarded compensation for damages if the organizer proves that the lack of conformity is attributable to the traveler or to a third party unrelated to the provision of the tourist services included in the tourist package contract and is unpredictable or unavoidable or is due to unavoidable circumstances and extraordinary.

    1. The package travel contract may provide for the limitation of the compensation payable by the organizer, except for damage to the person or those used intentionally or negatively, provided that the limitation is not lower than three times the total price of the package.

    2. The compensation or reduction of the price granted under the Tourism Code and the compensation or reduction of the price granted under the other applicable Community regulations and international conventions must be deducted from each other.



The seller must indicate his own quality and is solely responsible for the execution of the mandate given to him by the traveler with the travel brokerage contract, regardless of whether the service is rendered by the seller himself, by his auxiliaries or persons in charge when acting in the exercise of their functions or by third parties whose work they make use of, as the fulfillment of the obligations assumed must be assessed with regard to the diligence required for the exercise of the corresponding professional activity.


If not expressly included in the price, it is possible and advisable to take out special insurance policies at the time of booking at the offices of the organizer or seller to cover the costs of withdrawal (always due except for the specific exceptions provided for by the tourism code) of which in point 10, as well as those deriving from accidents and / or illnesses that also cover the costs of repatriation and for the loss and / or damage of luggage. The rights arising from the insurance contracts must be exercised by the traveler directly against the contracting insurance companies, under the conditions and in the manner provided for in the policies themselves, paying particular attention to the timing for the opening of the claim, the deductibles, limitations and exclusions. The insurance contract in place between the traveler and the insurance company has the force of law between the parties and has its effects between the traveler and the insurance company pursuant to art. 1905 cc

Travelers, at the time of booking, must notify the seller of any specific needs or problems for which it is necessary and / or appropriate to issue policies other than those proposed or included in the package price.


The organizer will provide the traveler with information regarding any existing complaints handling procedures and alternative dispute resolution mechanisms (ADR - Alternative Dispute Resolution), pursuant to Legislative Decree 6 September 2005, n. 206 and, if present, to the ADR body by which the trader is governed and to the online dispute resolution platform pursuant to regulation (EU) no. 524/2013.


21.3 The same guarantees are provided by professionals who facilitate connected tourist services for the reimbursement of all payments they receive from travelers, insofar as a tourist service that is part of a connected tourist service is not carried out due to the state of insolvency or failure of professionals.


Contracts relating to the offer of the transport service only, the accommodation service only, or any other separate tourist service, cannot be configured as a negotiating case of travel organization or tourist package, do not enjoy the protections provided for by tourism code and the contractual conditions of the individual supplier will apply. The responsibility for the correct fulfillment of the contract lies with the service provider. In case of booking of connected tourist services, the traveler has a protection aimed at reimbursing the payments received for services not provided due to the insolvency of the professional who collected the sums paid by the traveler. This protection does not provide for any reimbursement in the event of the insolvency of the relevant service provider.






Compensation in the event of death or injury: There are no financial limits on liability in the event of passenger injury or death. For damages up to 100,000 SDRs (equivalent to approximately 121,000 euros) the air carrier cannot contest claims for compensation. Beyond this amount, the air carrier can contest a claim for compensation only if it is able to prove that the damage is not attributable to it - Advance payments: in the event of injury or death of a passenger, the carrier must pay within 15 days from the identification of the person entitled to compensation, an advance payment to meet immediate economic needs. In the event of death, the advance payment cannot be less than 16,000 SDRs (equivalent to approximately 19,400 euros) - delays in the transport of passengers: In case of delay, the carrier is liable for the damage unless it has taken all measures possible to avoid it or that it was impossible to take such measures. The liability for the damage is limited to 4,150 SDRs (equivalent to approximately 5,000 euros) - Delays in the carriage of baggage: In case of delay, the air carrier is liable for the damage unless it has taken all possible measures to avoid it or that it was impossible to take such measures. In the event that the checked baggage is damaged, the passenger must make a written complaint within 7 days, and in the event of delay within 21 days, from the date on which the baggage was made available to the passenger - Liability of the contracting carrier and the Acting Carrier: If the air carrier operating the flight is not the contracting air carrier, the passenger has the right to make a claim or complaint to both.
